License Agreement

License Agreement Read the following terms and conditions carefully before using the enclosed software. Use of the Software within this package indicates your acceptance of these terms and conditions. If you do not agree with them, you should promptly return the package in its entirety. License

1. Grant of License. Herff Jones, Inc. ("Herff Jones") grants you a license to use the enclosed software program(s) (the "Software") subject to the license restrictions set forth below. This is a license agreement and not an agreement for sale. The licensed software, all enhancements and derivative works (called "Software") and all copyrights and other proprietary rights to the Software are the sole property of Herff Jones. The Software contains valuable trade secrets of Herff Jones. The license is a non-exclusive personal non-transferable license to use the Software for school-related purposes only.

2. Restrictions on Use. You may use the Software on as many computers as you wish within the schools that have a signed picture contract with Herff Jones Photography. You may copy the Software as necessary to enable you to use the Software as described above. You will use the Software for school-related purposes only, on any compatible computer located in your school. The License Agreement does not include use of the Software (or material contained therein) in connection with any commercial activities, fund-raising efforts and/or preparation on any materials intended for sale to third parties (including, without limitation, students and their families). You will treat the Software as confidential and will not copy, reproduce, sub-license or transfer the Software of copy any part of it or otherwise disclose the Software to third parties

4. Copyright. The ImagePAK Software is owned by Herff Jones or its suppliers and is protected by copyright laws and international treaties. You may not copy the Software, or elements, other than as expressly provided in the license. You will not alter, merge, modify, translate, adapt, disassemble, decompile or reverse engineer the Software in any way.

5. Term. This license is effective until terminated. You may terminate it at any time by destroying the Software, together with all copies in any form. It will also terminate if you fail to comply with any term or condition of this Agreement. You agree upon such termination to destroy the Software, together will all copies in any form. The Software will terminate at the end of each academic year, or July 1st. You must have a valid contract with Herff Jones or one of its authorized agents to reactivate the Software. Contact you Herff Jones representative or agent to renew you subscription. Limited Warranty For a period of 90 days after the date of delivery of the Software to you, Herff Jones warrants (i) the Software will perform substantially in accordance with the accompanying written materials, and (ii) the media on which the Software is furnished will be free from defects in materials and workmanship under normal use.

Herff Jones does not warrant that the functions contained in the Software will meet your requirements or that the operation of the Software will be uninterrupted or error free. You assume responsibility for operation of the Software to achieve your intended results, and for the installation, use, and results obtained from the Software. Subject to any applicable legislation which prohibits the following exclusions,

Herff Jones MAKES NO OTHER WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Government Restricted Rights The Software and documentation are provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subdivision (b)(3)(ii) of The Rights in Technical Data and Computer Software clause 252.227-7013. As diligently as we try, there are times where program corrections and enhancements must be made. Windows

The current Windows 2000/XP Image Pak revision is version 5.9.27. To upgrade, you must have at least version 5.8 or higher. Herff Jones no longer supports any version earlier than 5.8.50

To determine your version number, simply launch Image Pak. At the main menu click the About button. Your version number will appear at the top of the information window. Important: Please note which version of ImagePak that you currently have.

Directions for updating Image Pak V5.8 or later to V5.9.27:
1. Download the executable to your hard (C:\) drive.
2. After the download is complete, double-click on the imagepak_upgrade.exe icon.
3. Use the default settings by just clicking the Next buttons until the update begins.
4. Confirm that the updated Image Pak executable is located in the Herff Jones\ImagePak 5 folder.

Special Date Template Solution

Create a unique recognition card for each of your students on his or her birthday or recognize all the students on one special day. A special Image Pak® template, Digital Template Utility or DTU, is designed to create custom birthday cards or recognition cards for each individual student. Each card will feature the student's name and picture and highlight a famous person who shares that student's date. Famous authors, presidents, musicians, leaders… the card encourages the student to find out more information about his or her birthday partner.

Three DTU's are available for download or you may download the DTU bundle to use all three designs of templates.

Screen Fonts

With Windows 2K your display must be set for small fonts in order for the ImagePAK system to be properly formatted for your screen display.

 The usual way to make the small font setting is:
1. Click the Start Menu
2. Click the Settings option. This will open the Control Panel Window.
3. Double Click on the Display icon.
4. Click on the Settings Tab.
5. If the screen setting is greater than 640x480 the option for Large or Small fonts should be available. Click on the drop menu selection and select Small Fonts.

Color Setting Errors

Image Pak 5.x requires that your monitor be set to support at least 16 bit color.
To adjust your color settings do the following:
1. Go to Start/Settings/Control Panel
2. Double click on the Display icon.
3. Click on the Settings tab.
4. Under Color Palette, Click on the black arrow.
5. From the drop down box, choose 16 bit or 24 bit.
6. Click the OK button.
